LIFESAVER PORTABLE POWER BANK SERVICE AGREEMENT

This User Agreement (the “Agreement”) is entered into by and between you (the “User”) and Lifesaver Power Ltd. or Lifesaver Power B.V. (together, “Lifesaver”, “we”, “us”, or the “Company”). By accessing or using the Lifesaver Portable Power Bank Service (the “Service”), you agree to be bound by this Agreement. Please read it carefully before using the Service.
a. Lifesaver: The company providing the portable power bank rental service.
b. User: Any individual or entity renting or using a Lifesaver power bank.
c. Service: The rental and use of portable power banks and related swap facilities provided by Lifesaver.
d. Power Bank: A portable charging device provided by Lifesaver for temporary use.
a. Power Bank Rental
Users may rent a Lifesaver power bank in exchange for a rental fee and a refundable deposit.
b. Rental Period
The rental period begins when the User removes the power bank from a Lifesaver machine and ends when it is successfully returned to a designated Lifesaver return point (or 5 days).
c. Fees and Deposits
Rental fees and deposits are charged at the time of rental. Deposits are refundable subject to timely return and the condition of the power bank, in accordance with this Agreement.
a. Unlimited Swaps
Users may swap power banks at participating Lifesaver locations during the rental period, subject to availability.
b. Return Deadline
To receive a full deposit refund, the power bank must be returned within five (5) days from the rental start date.
c. Late Returns
Late returns may result in partial or full forfeiture of the deposit, depending on the length of delay and condition of the power bank.
a. Care and Custody
Users are responsible for the power bank while it is in their possession and must take reasonable care to prevent loss, theft, or damage.
b. Proper Use
Users must use the power bank only for its intended purpose and in accordance with any instructions provided. Users must not open, tamper with, modify, attempt to repair, submerge in water, expose to excessive heat, or otherwise misuse the power bank.
c. Loss, Theft, or Damage
If a power bank is lost, stolen, not returned, or returned damaged or unusable, Lifesaver may retain all or part of the deposit. Where repair or replacement costs exceed the deposit amount, Lifesaver reserves the right to charge the User for the additional costs incurred.
d. Device Compatibility and Charging Responsibility
Lifesaver does not guarantee that the power bank will charge all devices. Users are solely responsible for ensuring their device is compatible, in suitable working condition, and capable of receiving charge. Lifesaver is not responsible for devices failing to charge, charging slowly, or not charging as expected.
e. Safety Check
Users must visually inspect the power bank before use. If the power bank appears damaged or unsafe, Users must not use it and must immediately contact Lifesaver at +44 333 880 4779 or support@lifesaverpower.com for guidance.
Lifesaver is not responsible for any damage to a User’s mobile phone, tablet, or other electronic device arising from use of the Service. Lifesaver is not responsible for loss of data, software issues, battery degradation, or any other device-related issues, whether direct or indirect.
The Service and power banks are provided “as is” and “as available”. To the maximum extent permitted by law, Lifesaver makes no warranties, express or implied, including but not limited to warranties of fitness for a particular purpose, merchantability, or non-infringement.
To the maximum extent permitted by law, Lifesaver shall not be liable for any indirect, incidental, consequential, or special losses or damages, including but not limited to loss of data, loss of use, or loss of opportunity, arising out of or in connection with use of the Service.
Lifesaver’s total liability to a User for any claim arising in connection with the Service shall not exceed the rental fee paid by the User for the relevant rental period.
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by law.
Lifesaver does not guarantee uninterrupted availability of the Service. Power banks, machines, or swap locations may be temporarily unavailable due to maintenance, technical issues, connectivity problems, venue restrictions, or circumstances beyond Lifesaver’s reasonable control.
Lifesaver reserves the right to suspend or terminate the Service or a User’s access to the Service at any time, without notice, where reasonably necessary to protect users, property, or the operation of the Service.
Lifesaver may update this Agreement from time to time by publishing revised terms on its website. Continued use of the Service constitutes acceptance of any updated terms.
This Agreement is governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
For Users located in the United Kingdom, this Agreement is entered into with Lifesaver Power Ltd.
For Users located in the European Union, this Agreement is entered into with Lifesaver Power B.V.

By using the Lifesaver Portable Power Bank Service, you confirm that you have read, understood, and agree to be bound by this Agreement.
Lifesaver Power reserves the right to change the terms, conditions, and notices under which the Lifesaver Power Website is offered, including but not limited to the charges associated with the use of the Lifesaver Power Website . You are responsible for regularly reviewing these terms and conditions and looking for changes.
2. USE OF WEBSITE
Unless otherwise specified, the Lifesaver Power Website is for your personal and noncommercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Website .
You may display and, subject to any expressly stated restrictions or limitations relating to specific material, electronically copy, download and print hard copy portions of the material from the different areas of the Website solely for your own noncommercial use. Any other use of materials on this Website, including but not limited to the modification, reproduction, distribution, republication, display or transmission of the content of this Website , without prior permission from Lifesaver Power.
Harassment in any manner or form on the Website , via e-mail and telephoning or by obscene or abusive language is strictly forbidden.
3. COPYRIGHTS AND TRADEMARKS
The entire content included in this Website , including but not limited to text, design, graphics, interfaces, or code and the selection and arrangements thereof is copyrighted as a collective work under the United Kingdom and other copyright laws, and is the property of Lifesaver Power. The collective work includes works that are licensed to Lifesaver Power ltd.. Copyright 2019. ALL RIGHTS RESERVED. All trademarks, service marks, and trade names (collectively the “Marks”) are trademarks or registered trademarks of and are proprietary to Lifesaver Power, or other respective owners that have granted Lifesaver Power the right and license to use such Marks.
4. NOTICES FOR CLAIMS OF COPYRIGHT INFRINGEMENT
Lifesaver Power respects the intellectual property of others, and we ask our users and visitors to do the same. Lifesaver Power will process and investigate notices of alleged infringement and will take appropriate actions under the Copyright, Designs and Patent Act 1988 and other applicable intellectual property laws. Upon receipt of notices complying with the Copyright, Designs and Patent Act 1988, Lifesaver Power will act to remove or disable access to any material found to be infringing or found to be the subject of infringing activity and will act to remove or disable access to any reference or link to material or activity that is found to be infringing.
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Lifesaver Power with a detailed document containing the information that you think have been copied.

These terms and conditions are applicable to you upon your accessing the Website. The provisions relating to Copyrights and Trademarks, Disclaimer, Claims, Limitation of Liability, Indemnification, Applicable Laws, Arbitration and General, shall survive any termination.

12. APPLICABLE LAWS
Your use of this Website shall be governed in all respects by the laws passed by the government of the United Kingdom. You agree that jurisdiction and venue in any legal proceeding directly or indirectly arising out of or relating to this Website (including but not limited to the use of Lifesaver Power products) shall be in London Courts. Any cause of action or claim you may have with respect to the Website (including but not limited to the use of Lifesaver Power products) must be commenced within one (1) year after the claim or cause of action arises. Lifesaver Power failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Lifesaver Power may assign its rights and duties under this Agreement to any party at any time without notice to you.
Lifesaver Power makes no representation that materials in the Website are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Website from locations outside the United Kingdom do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the materials in violation of U.K. export laws and regulations.
13. ARBITRATION
By using this Website , you agree that Lifesaver Power, at its sole discretion, may require you to submit any disputes arising from the use of this Website , or these Terms and Conditions concerning or, including disputes arising from or concerning their interpretation, violation, nullity, invalidity, non-performance or termination, as well as disputes about filling gaps in this contract or its adaptation to newly arisen circumstances, to final and binding arbitration under the laws of the United Kingdom, by one or more arbitrators appointed in accordance with the said Rules. Any award in an arbitration initiated under this clause shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount.
